End User License Agreement

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User" or "you") and Kumalabs ("Licensor", "we", "us") for the use of KumaSH ("Licensed Application" or "the App").

By downloading, installing, or using the Licensed Application, you agree to be bound by the terms of this Agreement. If you do not agree, do not download, install, or use the App.

1. Scope of License

Kumalabs grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

This license does not allow you to:

• Distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time
• Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application
• Copy (except as expressly permitted by this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application

2. Licensed Application Description

KumaSH is an iOS application that provides SSH terminal, MOSH connection, and Claude Code AI integration capabilities. The App functions as a client connecting to user-configured remote servers and services.

3. Consent to Use of Data

You agree that the Licensor may collect and use technical data and related information — including but not limited to technical information about your device, system software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the Licensed Application. The Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

4. Maintenance and Support

Kumalabs is solely responsible for providing maintenance and support services for the Licensed Application, as specified in this Agreement or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

5. Warranty

THE LICENSED APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Kumalabs, to the extent required by applicable law.

6. Product Claims

Kumalabs, not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:

• Product liability claims
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

7. Intellectual Property Rights

Kumalabs, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to the Licensed Application.

8. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties
• You will comply with all applicable export and import laws and regulations

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KUMALABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Licensed Application
• Any unauthorized access to or use of your data
• Commands executed on remote servers through the App
• Any interruption or cessation of transmission

10. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application. This includes, but is not limited to, the terms of service of any remote servers you connect to and Anthropic's terms for Claude AI services.

11. Third-Party Beneficiary

Kumalabs and you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

12. Termination

This Agreement is effective until terminated by you or Kumalabs. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you shall cease all use of the Licensed Application and destroy all copies.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Vietnam.
